司法文书在我国起源于周代（约公元前11世纪）。《周礼》中有“史掌官书以赞治”，“掌万民之判”，“凡有责者，有判书以治，则听”的记载。汉代扬雄根据综判取士，以原告与被告之词判其曲直。梁刘勰在《文心雕龙·书记》篇中所列举的“律者”、“契者”、“劵者”，均属司法文书的范畴。明代吴讷和徐师曾均将判词列入独立的文体予以论述。 (责任编辑：) |
